Marintech Group OÜ is the data controller handling personal data; Marintech Group OÜ forwards personal data required for making payments to the authorized data processor Maksekeskus AS.

Which personal data is handled: customer’s name, phone number, email address; delivery address; bank account number; cost of goods and services, information related to payments (purchase history); customer support data.

What is the purpose of handling personal data: personal data shall be used for processing the customer’s orders and for delivering the goods. Data connected with the purchase history (purchase date, goods, amount, customer information) shall be used for compiling an overview of purchased goods and services, and for analyzing customer preferences. The bank account number shall be used for returning payments to the customer. Personal data such as customer’s email, phone number, and name shall be used for solving any disputes related to the provision of goods or services (i.e. customer support). The IP address or other network identificators of an online store visitor shall be used for providing the online store service as an information society service, and for online statistics.

Legal basis: Personal data shall be handled with the purpose of fulfilling the contract concluded with the customer. Personal data shall be handled to fulfil a legal obligation (e.g. accounting and solving consumer disputes).

Recipients whom personal data shall be forwarded to: personal data shall be forwarded to the customer service of the online store to manage purchases and purchase history, and to solve any problems customers might have. Name, phone number, and email address shall be forwarded to the delivery service provider chosen by the customer. If the goods are to be delivered using a courier, the customer’s address shall also be forwarded to the delivery service provider. If the website accounting is done by a service provider, personal data shall be forwarded to this service provider for book-keeping activities. Personal data could also be forwarded to the providers of IT-services, should it be required for guaranteeing the functionality of the online store or data storage purposes. Security and access to data: personal data shall be stored in the servers of ShopRoller Äritarkvara OÜ, physically located on the territory of a EU Member State, or on the territory of an EEC member state. Data could be forwarded to countries the data protection level of which has been assessed as „adequate” by the European Commission, and to companies based in the USA that have joined the Privacy Shield framework. The staff of the online store have access to personal data and they can access the personal data to solve any technical issues related to using the online store, and to provide customer support. The online store applies relevant physical, organizational, and IT security measures to protect the personal data from accidental or illegal destruction, loss, changing, and unauthorized access and disclosure. Forwarding personal data to the authorized staff of the online store (e.g. transport service and data storage providers) occurs according to contracts concluded between the online store and the authorized data processors. The authorized data processors are obliged to guarantee pertinent protective measures when using the received personal data.

Accessing and changing personal data: personal data can be accessed and changed in the online store user profile. If the purchase was done without a registered user account, personal data can be accessed via customer support.
Reverting approval: if personal data is processed at the consent of the customer, the customer is entitled to revert the approval by sending a corresponding email to the customer support.

Storage: when an online store customer account is closed, personal data shall be deleted – except in the case when such data must be stored for accounting purposes or for solving consumer disputes. If a purchase was done without a registered user account, the online store shall retain the purchase history for three years. In the case of any disputes related to payments or consumer disputes, personal data shall be stored until the dispute is solved, or until the end of the limitation period. Personal data required for accounting shall be stored for seven years.

Deletion: should a customer wish to delete their personal data, they should contact customer support via email. The deletion request shall be replied to within a month and it will be clarified which period the data will be deleted for.

Transfer: the request to transfer personal data, submitted by email, shall be replied to within a month. The customer support shall identify the person and notify about the personal data to be transferred.

Direct marketing messages: if the customer has given the corresponding consent, the email address and phone number shall be used for sending direct marketing messages. If the customer does not wish to receive any direct marketing messages, they should click on a corresponding link in the email footer, or contact customer support.
If personal data is processed for the purpose of direct marketing (profiling), the customer is entitled to object the preliminary and any following processing of their personal data, including profiling activities related to direct marketing, at any time by informing the customer support by email.

Settlement of disputes: disputes related to the handling of personal data shall occur through customer support shop[at]balticboatnet.eu. The supervisory institution is: The Data Protection Inspectorate of the Republic of Estonia (info[at]aki.ee).
